A friend of mine has PhD in aeronautics from a top tier university here in US. He will be soon starting teaching in a university and planning to file his GC under EB-1.
Are there any risks in getting I-140 approved under EB-1? or just having a PhD does not automatically qualify anyone under EB-1 category.?
Since he is born in India so reluctant to file under EB-2 due to endless wait.
Generally, Just having a Phd degree is not enough to file for EB1. Every case is different, sometimes, it depends on the field of study also - so, consulting an experienced attorney is recommended.

I'm also in the same situation. My attorney says wait till USCIS figures out that there are duplicates and sends a notice to withdraw one of the petitions. Of course, the checks would be en-cashed for both the petitions.

I agree. For example, in Germany, it is hard to work if you do not speak German. Also in France and all others.

I think that it was a trial balloon. I have seen this pattern for most of the major issues this administration is planning to tackle. Take TARP for example...for a month one would just hear leaks about proposed solutions. Media would pick it up and give a reaction, the next leak would be an updated version based on the feedback. Such articles help keep the issue in the forefront, help gauge the reaction (both positive and negative) and provide a simple exit to backtrack incase of major opposition. :rolleyes:

COBRA is a good option but I know its crazy expensive. They also have a high deductible plan. If your friend does not have kids (or even if he does) you could opt for HD plan - their premiums are much lower (< $500 for family). eg. for a doctors visit, under normal plan he would be paying 40$ copay and insurance would pay in-network negotiated rate of say $120. With HD plan he would need to pay $120 for doctors visit until he reaches deductible of $6k for the year. Not a bad option if you are healthy individual - covers you well in worst case scenario... Ask your family doctor in india to send you imp drugs, antibiotics etc etc. Within 100$ you can cover all medicine expenses...

Is letter from employee needed for filing I-485 for my spouse. I filed I-485 under EB3 last August and it's still pending. She takes my PD and my PD will be current in May. I have an old letter from my employer when filing my I-485 last August but was wondering if a new letter from employer is needed or the old one would do.

Please while protesting, Try to position yourself in ways where the society will accept you. I took sociology and learnt a great deal and I feel minorities need to find a common ground and establish themselves with a new society. Please do not make them detest us or bully us in anyway. I am not an attorney but questions related to your employer etc should not be asked if you enter on AP. They are more focused on those questions when one enters using a work visa of some sorts. I suggest you enter asap using your AP given that it expires in a month get your green card in hand and then you are free man. You can even go back work out of the country for a limited time until you find a project here. By the way congratulations.

You should be able to work with any company provided they are ready to give you support when USCIS asks for an RFE about your employment status.
Also you have to make sure that your job fall in the same description that you have filed the 485 for.
