As per INA Sec 101(b), the definition of child is dependent who is unmarried and under 21 years old. The Child Status Protection Act (2002) provides some additional relief. This article could be useful for you -

our ead is expiring in sep1st week. My attorney has just filed for ead renewal, am still waiting for a receipt no.
Since am working in H1 and not used EAD yet, i wont have any problem.
My wife is currently working on H1B and had plan to switch on EAD, although she has not started using the current EAD.
And her H1 is also expiring in september.
I am now afraid what will happen if her EAD doesnot get renewed before the expiry date. She may neither be able to work in H1 nor EAD.

I'm trying to do H1 transfer but my case has some complications and henc am worried if I should go forward or stick with my current company though they are sucking my blood outright.
1. My company does not give me paystubs(which I know is illegal, but they are ruthless that they might withdraw their application if I fight them). Is it possible to do H1 transfer with one paystub if I somehow manage to get one from them(By lyin as in for bank loan)?
2. I had done only undergrad (3 yrs) when they applied for my H1. I had my MBA going but havent graduated when H1 applied and they actually applied by putting my part time experince as full time experience and got my H1. They totaly masked my masters.Is it advisable to continue with my 3 yrs degree and partly fake experience or put my masters in the transfer appln. Would I get any query on that? But one good explanation is I finished my MBs around the same time as I applied H1 and so I can explain it to USCIS but still I'm worried. Any body in smilar boat?

You do need an H1 amendment. Had you applied for an LCA prior to starting your work in the new location, an amendend H1 would not have been required. But since you have already started working, you will need a new LCA and a new H1

Is there a way I can apply for a green card during residency for a future job two years down the road?
Same question came up for my wife in 2004 when she did not yet have a licence to practice dentistry and she wanted to apply as a dentist and our attorney told as that during LC when advertisments are placed at that time you should have the degree and the licence ready so as to apply for that particular job.My wife got her licence in 2005.Hope this answers your question.

My situation:
1. My six year limit on my H-1B expires Jan 2008
2. My Priority Date is Jan 06 under EB3 category
3. My I-140 was approved on Sep 06
4. Currently waiting on my Priority Date to become current so that I-485 can be applied.

Hi. I realized that I made a mistake when filling out the I 485 Part Three:
Processing Information. Specifically, I filled in the I-94 number issued for my H1B as the "Nonimmigration Visa Number", instead of the visa number I got when I was still in F1 Student status.
I called USCIS twice and they informed me that I can make corrections after I get the receipt--I can send in a corrected form, along with a letter explaining the correction, and also a copy of the receipt.
I was wondering whether anyone here had done that before.
I am kicking myself for misunderstanding the form! Please help!

HI,
My EB2 perm labor was approved recently and thinking of filing I 140.
Trying to port my EB3 PD, 09/23/2003 to EB2.
I missed filing I 1485 for my wife in july 2007.
My question is if I go ahead and file I 140 premium for me , lets say it gets approved soon ,my dates will be current.Should I file I 485 for my wife then ?
What happens if they approve my I 485 before I file my wife's 485.

I also have a similar case of 2 485s . I have EB2 priority date of September 2005 and not yet approved. May be multiple A # make it complex. I am planning to take an infopass apppointment and talk to IO and inform that we have 2 A#. Let us know how your appointment goes

I got a labor substitution and filed for my I-140 and I-485 concurrently. Today was the last day to send the documents and some paperwork was missing for my wife! I missed sending the package!
Now how should i proceed?? My wife is on H1-B currently. Any ideas??

If the priority dates are not current for the category in which your parents are seeking a green card, then they will have to wait for the priority dates to become current before they can apply I-485. You can check the Visa Bulletin for more info.

Technically you have to wait till Aug 1.

I know if you consultant you get paid by hours but not when you become full time employee.
As said earlier, overtime is paid to non-exempt employees. As a white collared employee's most of us are not eligible for overtime. when working as a consultant, your employee contract (if not explicitly, implicitly) gives you a bonus for the overtime that you do. There is no requirement. If you are consulting though, your company might bill overtime if you work overtime, it may or maynot decide to give you that even if they are getting it.

Ok, guys so I am going thru my annual ritual of H1/H4 renewal. I have never tracked the H1 processing on the USCIS site in the past. This time I decided to track it. I notice that my wife's H4 has been approved (been over a week) and mailed but there has been no activity on my H1 ! Does that make any sense? Isn't H4 a derivative visa that is approved only if H1 is approved?

Hello All,
When I was doing my education (MS) my credit dropped drastically and recently like 2 years back it went for collections too. However I cleared all my credit card debts but it still shows on the credit report that as severe deliquencies and number of open accounts.
Next month I'm applying for AOS - I want to know whether bad credit will have any affect of the approval or denial of the application? :mad:
Any suggestion is appreciated.

Although I am not going anywhere, as summer rolls along, visions of distant lands dance in my head. However, that vision is marred by long lines at the airports--- getting your luggage checked, getting into a plane with carry on bags and no overhead place, and finally the immigration and customs line ups.
This year, for a fee, the Government and even some airlines are helping to ease that pain.
The US Government, (and some foreign Government as well like Holland) has introduced the Global Entry Program. US Citizens over the age of 14 can pay a fee of $100/- (valid for 5 years) and enroll in the program. They have to enter their data in the following web site:

After the completion of the process, there will be a one time only CBP interview.
However, once its complete, you do not need to stand in any immigration line. There are kiosks in most major airports. The traveler has to scan in their passport at airport kisoks, and zoom down to luggage claim.
Similarly, in Houston IAH, international travelers who are US Citizens and has no checked luggage, can go through the lines used by pilots and air hostesses for faster processing.
This process can be used by anyone, but because of the lengthy process to get into the program, its probably feasible for frequent business travelers only. The travelers also get expedited check in in kiosks of other participating countries as well. As more countries sign on, the price may come down. Or this may simply become a requirement for foreign travel in the future. It will save money on personnel for countries participating in this program.
Additionally, some airlines are also letting passengers cut in line for boarding the plane or for checking in for a fee. Both American and South West is going to be offering this perk for a fee ranging from $10/- to $50/- per ticket.
This will be the future of travel, in a world increasingly short for time. But then, in this world, will there even be time for vacations?
