Last week I had the unfortunate experience of being "let go". This is my current situation:
EB-2 India PD July 2008
I-140 approved in April 2009
Currently on 7th year of my H1-B which is valid till May 2013.
Now the question I have is, if I were to transfer my H1-B visa to some other company (non consulting fulltime role), will I get an additional 3 years extension, i.e., till Oct 2013 or will it be only till May 2013?
Greatly appreciate any thoughts here. Thanks!

My student advisor asking me to show the I-94 Parole not expired, i didn't renew my AP last year since i was not going to travel.

Is there a chance of USCIS coming back and saying that they will not take applications for I485 after July 31 2007 for whatever crap reason?

I had a rfe on my 140. About a degree from Bombay University. After the reply within 48 hours my case was approved.

I received an RFE on my I-140. I responded to NSC last week with what was requested in RFE. NSC acknowledged receipt of my response. How long do you think it would take for them to take a decision on my case (non-premium process).

I was told that, if we do not see any activity for 90 days, then we can contact USCIS to raise a Service Request.

I have an apporved I/140 and RD of I/485 in May 2007 under EB3. The PD is april 01 which is unavailable per current VB. My H1 is expiring in Jan 08 (9th yr extn.) Should I get my H1 extended and also can I do it myself? Kindly advise if I go for premium processing for H1 extn., can I get it extended for 3 yrs? Any related link for extn. be appreciated. Thanks

I just thought of sharing some good news. I spoke this afternoon with USCIS office about my pending EAD(renewal), at the same time I asked the lady to check my I485 (PD: 11/08/2005), she forwarded my call to Level 2 support guys. He said FP,NC,Back ground check everything is cleared and also case is assigned to IO.
Just a small suggestion/clue to my friends,
when ever they ask "when did u file the application(I485) tell them your PD not the date that we all recently applied(if you have applied recently, I mean last year Jul/Aug)". Also don't call them on Mon-Wed, call them on Thursday or Friday (I recommend), so they will answer you guys politely. Complement for every say of them. Just a good word or humble will pay us back. I am sure about that.
Please don't take me wrong.

I did the same with my family in 05. Pretty simple. Go for it. Good Luck. Make sure MARK YES to the question of Your Status in Canada as Permanent Landed Immigrant while filling up the form for H1 intervies at American Embassy.

Yes they need to give you lay off notice officially in paper and give you plane ticket to India.
You can file the complaint and once they give you ticket to India , you can available that to go to India.
In fact H1Bs shouldn't have been approved for your employer in first place. Obviously in your case the client is delaying payment but you employers need to have the
working capital to pay you even if the client is not/delaying payment.
This was a problem/abuse with the small consulting companies aka body shoppers for over a decade now. It seems that USCIS is eventually cracking down on this.

Can someone clarify the situation of 485 being approved while one is outside of USA. In such a case, if one does not have AP to return to US, then is it considered that the 485 petition is abandoned and one cannot use the approved 485?
I vaguely remember seeing that even if one has valid H1B (or get renewal stamping outside USA), travelling like above situation is risky without AP.
Thoughts?
If you have a valid visa status and by some miracle your green card is approved while you are on vacation this should not be a problem.
If you have travel plans and your priority date is not current this is a pretty good indicator of the chances of this happening.

Check for 340 Payable to US Department of Homeland Security" (with A#/Name in the memo section) -- Separate checks

Guys, today I got our permanent residence visa from Canadian consular in LA that I almost had applied three years ago.
The visa is valid until June 9, 2007 and I really can not get my job done here in US until then. It is just too close. Even kinds will be in school by then.
Any one knows that if I can apply for an extension or not? I really don�t want to let it go since we spent so much money for it.

If your company is financially strong and can prove that they can pay your salary, then you will not have any problem. If your company is small and have only couple of consultants working and the earnings are less then you might have issues.

To the guy who who told me to edit post. there are tons of other posts with irrelevant stuff. i didnt see u jumping on them.
I am trying to be as close to relevant as I can be. As i said, a past legislation doesn't mean future legislation would be same BUT it definitively give us a lesson what we should strive to prevent....
and whatever the 2006 and 2007 legislation were - they were. I didn't made them up myself. So, I cant edit them...lol...

The IB system is offered by many charter schools. These schools are public schools but have been set up through a charter agreed to by the parents. They are public schools managed by parents. You do not have to pay anything for your child to attend one of these (At least in the great state of GA, u dont).

My lawyer is saying you need a valid reason to apply. My wife wants to visit India when i asked he said you cannot apply AP for visiting purpose, you need a valid reason to apply and a letter or wedding invitation to apply.

What is sh.... lawyer.. You only need a valid reason for expediting your AP application. For regular applications, they don't even have a column asking for any valid reason.

IV is not for any particular nationals. While ROW is also affected because of retrogression, India and China are severely affected and there is hardly any movement in EB2/3 for India. The hard country limits in EB system and inability to capture unused visa numbers are just 2 of the many reasons responsible for retrogression. These forums have been misused by some people to advertise about their firm. May be the other member skimmed through the post and considered it a similar ad. OP has given a fitting response. Welcome to IV.
